Terms and conditions

Provider: Beesender, UAB (Legal entity code: 305577578, Address: Vilniaus St. 31, LT-01402 Vilnius, Lithuania).
1. SCOPE OF SERVICES
These Terms and Conditions govern the use of the Beesender software ecosystem, which includes:
Platform Modules: Beesender Chat Master, Beesender Bot Master, Beesender Omnichannel, Beesender Outbound, and Beesender AI Chat Assistant.
Ready-made Solutions: Beesender Welcome bot and Beesender Feedback bot (standardized bots with pre-defined logic).
2. TECHNICAL ARCHITECTURE AND DATA LOCALIZATION
The Service operates under a hybrid model designed to ensure data security and privacy:
Customer IT Perimeter: All Beesender modules (including Chat Master and bots) are installed directly into the Customer’s Creatio environment.
Environment Identity: Beesender modules reside wherever the Customer’s Creatio instance is hosted (Public Cloud, Private Cloud, or On-premise). All communication history and bot configurations are stored exclusively within the Customer's database.
Beesender Cloud Connector: This component acts solely as a transit node responsible for message traffic management between external channels (Messengers, Social Networks, Live Chat) and the Customer's IT perimeter.
Zero-Storage Policy: The Cloud Connector does not record, store, or perform analytics on the content of communications between the Customer and their clients.
3. FILE STORAGE AND RETENTION POLICY
While text messages are processed in transit, media files (images, documents, audio/video) require temporary hosting:
Temporary Hosting: Files are temporarily stored on the Provider's file server to facilitate delivery to the Customer's CRM.
Retention Authority: The retention period for files on the Provider's servers is determined solely by the Provider in accordance with its internal technical policies.
Automatic Deletion: Files are automatically deleted upon the expiration of the retention period. The Customer is responsible for ensuring that all necessary files are archived within their own IT perimeter prior to deletion.
4. DATA PROTECTION (GDPR)
Compliance: The Provider processes personal data in accordance with the General Data Protection Regulation (EU) 2016/679 (GDPR) and the laws of the Republic of Lithuania.
Roles: The Customer acts as the Data Controller. The Provider acts as the Data Processor regarding the transit of messages and temporary file storage.
Security: The Provider implements physical and technical measures to protect data from unauthorized access, loss, or alteration. Employees are bound by strict confidentiality agreements.
5. LIMITATION OF LIABILITY
Content: The Provider is not responsible for the content of messages transmitted through the software.
Third-Party Platforms: The Provider is not liable for service interruptions caused by external messenger APIs or the Creatio platform.
Data Loss: The Provider shall not be liable for the loss of files once they are deleted according to the established Retention Policy (Section 3).
6. GOVERNING LAW
These Terms are governed by the laws of the Republic of Lithuania. Any disputes shall be settled through negotiations via contact@beesender.com or, if unresolved, in the courts of Vilnius, Lithuania.
